1. Acceptance of Terms

By downloading, installing, or using Recaster ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

These Terms constitute a legal agreement between you and PixelMorph ("we", "our", or "us").

2. Age Requirement

You must be at least 18 years of age to use Recaster. By downloading, installing, or using the Software, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use this Software under any circumstances.

We reserve the right to request proof of age and to terminate accounts of users who misrepresent their age.

3. License Grant

Free Tier

We grant you a non-exclusive, non-transferable, revocable license to use Recaster Free for personal and commercial purposes, subject to these Terms and applicable law.

Studio Tier

Upon purchase of a Studio license, we grant you a perpetual, non-exclusive, non-transferable license to use Recaster Studio on up to two (2) devices you personally own and operate. The license is tied to your email address and may not be shared or resold.

4. Responsible Use & Prohibited Activities

Recaster is a powerful tool for face synthesis. With this capability comes responsibility. You agree to the following conditions, which align with the OpenRAIL-AS license used by many AI models integrated in this software:

You MUST:

  • Obtain consent — Have explicit, verifiable permission from all identifiable individuals whose likeness you use. For commercial use, we strongly recommend obtaining written consent. Consent is required regardless of whether the content is parody, satire, or artistic expression, unless clearly protected by applicable law.
  • Disclose synthetic content — Clearly and conspicuously label AI-generated or manipulated content when sharing publicly. This disclosure must be visible to viewers and should include language such as "Created with AI" or "Digitally altered."
  • Comply with all applicable laws — Follow all applicable local, state, national, and international laws regarding synthetic media, including but not limited to deepfake laws, right of publicity laws, defamation laws, and privacy regulations.
  • Verify age of subjects — Ensure that all individuals depicted in your content are adults (18 years of age or older). If you have any doubt about a person's age, do not use their likeness.

You MUST NOT:

  • Create non-consensual intimate imagery (NCII) — Generate sexual, intimate, or nude imagery of any real person without their explicit, documented consent. This includes so-called "deepfake pornography." Violation may constitute a criminal offense in most US states and many countries, including under the federal TAKE IT DOWN Act.
  • Create any content depicting minors — Generate any sexual, intimate, or exploitative content depicting minors (persons under 18), whether real or fictional. This includes AI-generated child sexual abuse material (CSAM), which is illegal under federal law (18 U.S.C. § 2256) regardless of whether real children were involved.
  • Create election interference content — Generate content intended to deceive voters about candidates, election procedures, or voting, particularly within 30-90 days of an election. Such content may violate state laws in Texas, California, and other jurisdictions.
  • Deceive or defraud — Create content intended to mislead others about real events, impersonate individuals for fraud, manipulate evidence, or conduct scams. This may violate FTC regulations and state fraud laws.
  • Harass or harm — Use the Software to bully, threaten, defame, stalk, extort, blackmail, or cause harm to individuals or groups.
  • Bypass content safety measures — Attempt to circumvent, disable, or evade Recaster's content safety systems, including the age detection system.

Warning: Violation of these terms may result in immediate license termination, reporting to law enforcement where appropriate, and potential civil or criminal liability. Creating NCII or CSAM is a serious crime that can result in imprisonment.

5. Content Safety System

Recaster includes automated content safety measures designed to prevent misuse:

Age Detection ("Challenge-25" Policy)

Recaster uses AI-based age estimation to help prevent processing of content that may involve minors. Our "Challenge-25" policy may block processing when detected faces appear to be under 25 years of age. This conservative threshold helps ensure no minors are processed, accounting for the inherent uncertainty in AI age estimation.

Important: This system is not perfect and may occasionally produce false positives (blocking adults who appear young) or false negatives. You remain solely responsible for ensuring all individuals in your content are adults who have consented.

Audit Logging

For compliance and safety purposes, Recaster maintains anonymized logs of blocked content events. These logs contain no images, videos, or personally identifiable information—only anonymized metadata such as timestamps, content type, and the reason for blocking.

Mandatory Reporting

We are required by federal law (18 U.S.C. § 2258A) to report any known or suspected child sexual abuse material (CSAM) to the National Center for Missing & Exploited Children (NCMEC). We will comply with law enforcement requests and legal process.

6. Intellectual Property

Recaster and its original content, features, and functionality are owned by PixelMorph and are protected by international copyright, trademark, and other intellectual property laws.

Content you create using Recaster belongs to you, subject to:

  • The rights (including right of publicity) of individuals depicted
  • Copyright of any source material you use
  • Consent requirements under applicable law
  • Disclosure requirements for AI-generated content

7. Third-Party Services

Recaster integrates with third-party services including:

  • Vast.ai — Cloud GPU rental (Studio tier)
  • Hugging Face — AI model downloads
  • Stripe — Payment processing
  • Sentry — Crash reporting (optional)
  • PostHog — Usage analytics (optional)

Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or conduct of third-party services.

8. International Users

European Union

If you are located in the European Union, your use of Recaster is subject to the General Data Protection Regulation (GDPR) and the EU AI Act. Effective August 2026, AI-generated content created with Recaster will include machine-readable markers indicating AI generation, as required by EU AI Act Article 50.

United Kingdom

If you are located in the United Kingdom, the UK GDPR, Data Protection Act 2018, and Online Safety Act 2023 apply to your use. Creating or sharing intimate deepfakes without consent is a criminal offense under UK law.

Other Jurisdictions

Many countries have laws regulating synthetic media, deepfakes, and privacy. You are responsible for understanding and complying with the laws of your jurisdiction.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS
  • ACCURACY OF AGE DETECTION OR OTHER SAFETY FEATURES

We do not warrant that the Software will be uninterrupted, error-free, or secure. AI models may produce unexpected or inaccurate results. Content safety systems may produce false positives or false negatives.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELMORPH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Business interruption
  • Reputational harm from content you create
  • Legal consequences of your use of the Software
  • Claims by third parties arising from content you create
  • Failures of content safety or age detection systems

Our total liability shall not exceed the amount you paid for the Software license in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless PixelMorph and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Software
  • Content you create with the Software
  • Your violation of these Terms
  • Your violation of any applicable law
  • Your violation of any third-party rights, including right of publicity
  • Any claims by individuals depicted in content you create

12. Termination

We may terminate or suspend your license immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Creating prohibited content (NCII, CSAM, election interference)
  • Fraudulent license use
  • Request by law enforcement
  • Circumventing content safety measures

Upon termination, you must cease all use of the Software and destroy any copies in your possession. Provisions that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Software shall be resolved exclusively in the state or federal courts located in Wyoming, except where prohibited by law.

For users in the European Union, this choice of law does not deprive you of the protection of mandatory consumer protection laws of your country of residence.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or in-app notification at least 30 days before changes take effect. Continued use of the Software after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
